Acceptable Use Policy

1. Introduction and scope

This Acceptable Use Policy ("AUP" or "Policy") governs your use of the website-design and hosting services offered at titanwebdesign.net (the "Service") by Titan Web Design ("Titan", "we", "us", or "our"), a sole proprietorship operating in the United States.

The Service lets a business owner pick a template, submit an intake form (business information, Google Business Profile link, logo, brand colors, page content, services, and photos), and receive a free demo website that an automated AI engine generates. If you subscribe, the demo becomes your live website hosted on your own domain, and you can request edits from your dashboard.

This Policy applies to:

  • everyone who submits an intake form or generates a demo, whether or not they pay;
  • every paying subscriber and every authorized user of an account;
  • all content you submit, upload, link to, request, or publish through the Service (your "Content"); and
  • every website, domain, email, edit request, and support interaction connected to your account.

This Policy is part of, and incorporated into, our Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service. If this Policy conflicts with the Terms of Service, the Terms of Service control unless they say otherwise. By using the Service, you agree to this Policy.

2. Your core responsibility for content

You are solely responsible for everything you submit to the Service and everything published on a website we build or host for you. You represent and warrant that:

  • you own, or have all rights and licenses necessary to use, every logo, image, photo, name, text, video, and other material you submit, and that you have the right to let us use, copy, modify, host, and publish it to build and operate your site;
  • your Content and your use of the Service do not violate any law, regulation, court order, or third-party right (including intellectual-property, privacy, and publicity rights);
  • the business information you provide is accurate and not misleading, and you are authorized to act for the business you represent; and
  • your Content and intended use comply with this Policy.

Because the Service is automated and built around AI, there is no guarantee that a human reviews your submission, your site, your edits, or your support messages before they are processed. You should not assume a person is checking your Content for legal or factual problems. The responsibility to keep your Content lawful and accurate stays with you.

3. How automated screening works

Every intake submission passes through an automated content-moderation gate before any demo site is generated and before any domain is registered. This gate uses AI classification (and may use third-party safety tools) to screen your submission against the prohibited and restricted categories in this Policy.

Based on that screening and our ongoing monitoring, we may:

  • allow the submission and generate the demo;
  • block the submission so that no site is generated and no domain is registered;
  • hold a borderline or flagged submission for additional automated or, where applicable, manual review before deciding; or
  • request more information from you before proceeding.

The automated gate is a safeguard, not a guarantee. Approval by the automated system does not mean your Content is lawful, non-infringing, or permitted, and it does not waive any term of this Policy. We may re-screen, re-evaluate, suspend, or remove Content at any time, including after a site goes live, if we later determine it violates this Policy. We may also use automated rate limiting, bot detection (such as a captcha), and daily build caps to protect the Service from abuse.

We are not obligated to monitor Content, but we may do so. We are not liable for failing to detect or act on prohibited Content, and our right to act under this Policy is a right and not a duty.

4. Prohibited content and conduct (hard bans)

You may not submit, request, publish, host, link to, or use the Service for any of the following. Submissions in these categories will be blocked by the moderation gate, and existing sites that fall into them are subject to immediate removal.

4.1 Illegal goods, services, and activity

  • Anything that violates federal, state, or local law, or facilitates illegal activity.
  • Sale, advertising, or facilitation of illegal drugs or controlled substances, illegal weapons, stolen goods, counterfeit goods, fake documents or credentials, or other unlawful products or services.
  • Human trafficking, exploitation, or any content that endangers others.
  • Money laundering, illegal gambling, or other unlawful financial activity.

4.2 Intellectual-property infringement

  • Copyrighted text, images, photos, logos, fonts, music, video, or other material that you do not own or do not have a license to use.
  • Trademarks, brand names, or logos that belong to someone else and that you are not authorized to use, including using another company's brand to imply a relationship that does not exist.
  • Content that infringes patents, trade secrets, or other proprietary rights.
  • Copying another business's website, copy, or design that you have no right to use.

4.3 Adult and sexual content

  • Pornography or sexually explicit material.
  • Escort, prostitution, or other adult-services solicitation.
  • Any sexual content involving minors. We report suspected child sexual abuse material to the National Center for Missing and Exploited Children (NCMEC) and to law enforcement as required by law, and we will terminate the account immediately.

4.4 Hateful, harassing, and violent content

  • Content that promotes hatred, harassment, or discrimination against people based on race, ethnicity, national origin, religion, sex, gender, gender identity, sexual orientation, disability, age, or other protected characteristics.
  • Threats, incitement of violence, glorification of violence, or content that promotes terrorism or violent extremism.
  • Harassment, bullying, doxxing, or sharing of private information without consent.

4.5 Fraud, scams, and deceptive schemes

  • Scams, phishing, fraud, or any attempt to deceive or steal from visitors.
  • Get-rich-quick schemes, pyramid or Ponzi schemes, fake investment "opportunities", and deceptive multi-level-marketing claims.
  • False, misleading, or unsubstantiated claims about products, services, prices, results, earnings, health outcomes, certifications, awards, or reviews.
  • Fake reviews, fake testimonials, fabricated credentials, or impersonating a licensed professional you are not.

4.6 Malware, phishing, and technical abuse

  • Distributing malware, viruses, ransomware, spyware, or other harmful code.
  • Phishing pages, credential-harvesting forms, or pages designed to imitate another site to deceive users.
  • Using the Service to attack, probe, scan, overload, or interfere with any system or network, including ours and our subprocessors'.
  • Cryptocurrency mining, denial-of-service tooling, or other resource-abuse activity on our infrastructure.

4.7 Impersonation and identity abuse

  • Impersonating any person, business, brand, or government entity, or falsely claiming to be affiliated with or endorsed by one.
  • Registering domains or building sites intended to mislead visitors about who operates the business (including typosquatting on another brand).
  • Providing false ownership or registrant information for a domain.

4.8 Spam and unsolicited messaging

  • Using the Service, or a site or email we provision, to send spam or unsolicited bulk or commercial messages.
  • Deceptive SEO, link schemes, cloaking, doorway pages, or other practices that violate search-engine or advertising-platform guidelines.

4.9 Privacy and data abuse

  • Collecting, publishing, or selling personal information without a lawful basis and proper notice.
  • Publishing another person's private or sensitive information without consent.
  • Building sites that unlawfully target children or collect data from children in violation of applicable law.

4.10 Third-party policy violations

You may not use the Service in any way that violates the policies of the providers that power it. Your site and your use must comply with the terms and acceptable-use policies of, at minimum:

  • Cloudflare (hosting, SSL, CDN);
  • Stripe (payments and prohibited-business rules);
  • Porkbun (domain registration and registrant requirements);
  • Google (Business Profile data and analytics); and
  • Meta (advertising pixel and platform policies).

A violation of any of these third-party policies is also a violation of this Policy, even if it is not otherwise listed here. These providers may independently suspend, remove, or refuse to serve content, and we may have no ability to override their decisions.

5. Restricted and regulated industries (flagged for review)

Some lawful businesses operate in regulated or higher-risk industries that require special compliance, licensing, or disclosures, or that are restricted by our payment processor or other providers. Submissions connected to these industries are not automatically banned, but they are flagged for additional review and may be held, limited, declined, or subject to extra conditions. These include, without limitation:

  • firearms, ammunition, weapons, and related accessories;
  • cannabis, CBD, hemp, and related products or services;
  • gambling, betting, sweepstakes, and games of chance;
  • pharmaceuticals, supplements, and health or medical claims;
  • financial services, lending, debt relief, "credit repair", investment advice, securities, and cryptocurrency or digital-asset solicitation;
  • adult-adjacent businesses, tobacco, vaping, and alcohol;
  • legal, accounting, and other licensed professional services making regulated claims.

If you operate in one of these areas, you are responsible for ensuring your site complies with all applicable licensing, disclosure, age-gating, and advertising rules. We may require proof of licensing or additional agreements before we build or publish, and we may decline service at our discretion. Some of these categories are prohibited by Stripe, Cloudflare, Porkbun, Google, or Meta, in which case we cannot serve them regardless of legality.

6. AI-specific terms

The Service uses third-party AI providers, including Anthropic (Claude) and Google (Gemini), to generate website text and images, and to power edits and support. You agree that:

  • you will not submit prompts or edit requests that attempt to generate prohibited Content, that try to bypass or manipulate the moderation gate, or that try to extract another customer's data;
  • AI-generated text and images may contain errors, and you are responsible for reviewing your site for accuracy before relying on it or publishing claims (for example, hours, pricing, licensing, certifications, and service-area statements);
  • you will not present AI-generated content in a way that is deceptive or that violates Section 4; and
  • you will not use the Service to build tools whose primary purpose is to generate disallowed content.

7. Account, security, and fair-use conduct

You must also:

  • keep your login credentials secure and not share access with unauthorized users;
  • not attempt to gain unauthorized access to the Service, other customers' accounts or sites, or our systems or those of our subprocessors;
  • not reverse engineer, scrape, resell, or sublicense the Service except as expressly allowed;
  • not abuse the free-demo system, the credit system, or promotions (for example, by submitting bulk demos to consume resources, or by manipulating credits);
  • not interfere with, overload, or disrupt the Service or its automated build, edit, and support pipelines; and
  • not use the Service in a way that creates legal exposure, security risk, or reputational harm for us or our providers.

8. Consequences of a violation

If we determine, in our reasonable discretion, that you have violated this Policy (or are likely to), we may take any one or more of the following actions, with or without notice depending on the severity and the risk involved:

  • reject or block the intake submission so no site is generated;
  • decline to register or to keep a domain;
  • hold a submission, demo, edit, or site for review;
  • remove, disable, or edit the offending Content;
  • suspend or terminate your account, your demo, or your live site;
  • take down or unpublish a live website and disable associated email or domain services;
  • refuse future service; and
  • report the matter to law enforcement or affected third parties where appropriate or legally required.

Refunds and billing on enforcement. How fees are handled when we enforce this Policy depends on the circumstances:

  • If we block or reject a free demo, no charge applies because demos are free.
  • If we terminate a paid account because you violated this Policy, refunds (if any) are governed by our Terms of Service and refund policy, and we may decline a refund for violations involving illegal content, fraud, or abuse. Where a refund is offered, it is handled within thirty (30) days of the qualifying event.
  • We may attempt to notify you and, where practical, give you a chance to fix a fixable violation before taking your site down, but we are not required to for serious or unlawful violations.

Termination for a violation does not entitle you to a refund of amounts already owed, and it does not limit any other remedy available to us. Site takedown may result in loss of your published site, email, and domain configuration; keep your own backups of any Content you care about.

9. Reporting abuse and copyright (DMCA-style) complaints

If you believe a site we host violates this Policy, infringes your rights, or is unlawful, please tell us.

For a copyright or trademark complaint, please include enough detail for us to act, including at least:

1. your name and contact information; 2. identification of the work or mark you say is infringed; 3. the URL or location of the allegedly infringing material on the site we host; 4. a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; 5. a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or are authorized to act on the owner's behalf; and 6. your physical or electronic signature.

We respond to valid notices consistent with the Digital Millennium Copyright Act (DMCA) and applicable law, which may include removing or disabling access to the material and, for repeat infringers, terminating accounts. We may forward your complaint (including your contact details) to the affected customer. Submitting a false or bad-faith complaint may carry legal consequences for you.

10. Relationship to third-party providers

The Service depends on third-party providers, including Stripe, Supabase, Cloudflare, Porkbun, Resend, Anthropic, Google, and Meta. These providers each have their own terms and policies, may enforce them independently, and may suspend or remove your site, domain, payments, or data for reasons outside our control. We are not responsible for their actions, and compliance with their policies is part of your obligations under this Policy.

11. Changes to this Policy

We may update this Policy from time to time, including by adding to or refining the list of prohibited and restricted categories as laws, provider policies, and abuse patterns change. When we make material changes, we will post the updated Policy with a new "Last updated" date and, where required, provide additional notice. Your continued use of the Service after a change takes effect means you accept the updated Policy. If you do not agree, stop using the Service and contact us.

12. Governing law and contact

This Policy is governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules, except where federal law applies. Any dispute is subject to the dispute-resolution and venue terms in our Terms of Service.
